By accessing and using the Mulberry & Second website (the "Site"), you agree to be bound by the following Terms of Service ("Terms"). Please read these Terms carefully before using our services. If you do not agree with any part of these Terms, you may not access the Site or use any of our services.

1. General Conditions

We reserve the right to refuse service to anyone for any reason at any time. You understand that your content (not including credit card information), may be transferred unencrypted and involve transmissions over various networks.

2. Products and Services

All products listed on the Site are pre-owned. We make every effort to display the condition and details of each item as accurately as possible. However, we cannot guarantee that your device's display of any product color or detail will be accurate. All descriptions of products or product pricing are subject to change at any time without notice, at our sole discretion. We reserve the right to discontinue any product at any time.

3. Pricing and Payments

All prices are listed in U.S. Dollars. We accept various forms of payment as indicated on the Site. By providing payment information, you represent and warrant that you have the legal right to use the payment method provided.

4. Shipping and Delivery

We offer free local pickup from our Northshore Chattanooga showroom. Once your order is placed, we will contact you within one business day to coordinate a pickup time that fits your schedule.

Smaller items can be shipped within the contiguous US via USPS or FedEx. Rates are calculated at checkout. If you would like an item shipped internationally, please contact us before placing your order.

For larger pieces, delivery can be arranged via local, national, or international freight providers. We are happy to handle these logistics for you for a fee, or you are welcome to coordinate your own preferred delivery service or courier.

5. Returns and Refunds

We want you to be completely happy with your Mulberry & Second purchase. If for any reason you are not, we will happily accept returns of eligible items within 7 days of your purchase date.

To be eligible for a return, the item must be in the same condition as when it was purchased. Items that show signs of new wear, damage, or alteration after the time of sale are not eligible for a refund. Returns are only accepted in the showroom, we do not accept returns of items that have been shipped.

6. Intellectual Property

The Site and all of its original content, features, and functionality are and will remain the exclusive property of Mulberry & Second. Our trademarks, logos, and trade dress may not be used in connection with any product or service without our prior written consent.

7. User Conduct

8. Limitation of Liability

In no case shall Mulberry & Second, our directors, employees, affiliates, agents, contractors, or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind.

These Terms of Service and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of the United States and the State of Tennessee.
